' f <br /> t, <br /> CONDITIONS OF APPROVAL <br /> PA-0900110 <br /> Windmill Cove Resort <br /> Entertainment Perhiit Application No. PA-0900110 was approved by the San Joaquin County <br /> Community Development Department on November 8, 2010. The effective date of approval is <br /> November 18,2010.1�This approval will expire on May 19, 2012,which is 18 months from the effective <br /> date of approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary <br /> building permits have been secured and remain in force, and (3) all necessary permits from other <br /> agencies have been:secured and remain in force. <br /> Sb <br /> x <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: John Funderburg, 468-3160) <br /> a. IMPROVEMENT PLAN: APPLICATION-IMPROVEMENT PLAN". The Site Plan required as a part <br /> of the improvement plan must be prepared by a registered civil engineer or licensed architect. This <br /> Plan must show drainage, driveway access details including gates, on-site parking, landscaping, <br /> signs, existing.and proposed utility services, and grading (refer to the"SITE PLAN CHECK LIST'for <br /> details). A fee:is required for the Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED�USE. This approval is for an Entertainment Permit for an existing marina and <br /> recreational uehicle park to include indoor and outdoor social activities (weddings, live <br /> entertainmeg.li fundraisers and corporate events) as shown on the site plan dated August 23, <br /> 2010. <br /> c. HOURS OF OPERATION: All entertainment establishments shall be closed and all patrons shall <br /> vacate the pr#raises between 2:00 a.m. and 6:00 a.m., except that as part of a New Year <br /> celebration, entertainment establishments may remain open until 3:00 a.m. on January 1st. <br /> (Development Title Section 9-1085.8 [a]) <br /> d. HOURS OF QPERATION (RESPONSIBLE PERSON): A Responsible Person must be present <br /> in the entertainment establishment during all hours that the entertainment establishment is open <br /> and offering entertainment. (Development Title Section 9-1085.8 [c]) <br /> e. NOISE ABATEMENT: Outdoor establishments shall comply with the requirements of section 9- <br /> 1025.9. , <br /> f. ORDERLY DISPERSAL REQUIRED: Each Responsible Person shall use reasonable efforts to <br /> cause the orderly dispersal of patrons from the vicinity of the establishment at closing time. <br /> (Development Title Section 9-1085.14) <br /> g.
