.I <br /> Background Case Information: <br /> Johnnie's Welding is located on 17701 E. Comstock Road (APN # 091-160-09 — <br /> approximately 0.28 acres) and 17703 E. Comstock Road (APN # 091-160-08 — <br /> approximately— 11.05 acres), Linden, CA 95236. <br /> The EHD acts as the Local Enforcement Agency (LEA) for the California Integrated <br /> Waste Management Board's Waste Tire Enforcement Program. <br /> On 3/14/05, Frank Girardi performed a routine waste tire inspection at the above- <br /> referenced site. The following violations were documented: PRC: 30 PRC 42951 - <br /> Waste Tire Hauler Registration, T14 CCR 18459 — Manifesting Requirements, 30 PRC <br /> 42834 —Minor Waste Tire Permit - T14 CCR 18423 —Filing of Application - T14 CCR <br /> 17341 — Title 14 CCR 17351 —Fire prevention measures, Title 14 CCR 17353 — Vector <br /> Control Measures, Title 14 CCR 17354— Storage of Waste Tires Outdoors. Photos were <br /> taken. <br /> A Letter of Violation (LOV) was issued and sent via Certified Mail on 3/17/05 citing the <br /> above violations. Johnnies Welding was given until 4/23/05 to correct the violations. <br /> On 4/4/05,unclaimed mail(LOV)was returned to EHD. <br /> On 4/7/05, a LOV with a revised compliance deadline (5/3/05)was sent via US mail. <br /> On 5/3/05, Frank Girardi and Robert McClellon conducted a site re-inspection. The <br /> violations were not corrected. Hand delivered copies of 3/14 inspection report and LOV <br /> dated 4/7/05 to operator. Compliance deadline set for 7/12/05. <br /> On 7/19/05, Frank Girardi and Robert McClellon conducted a re-inspection. Observed <br /> approximately 100 tires stored in front of property for removal. No tires have been <br /> removed. Operator agreed to have tires removed by 7/22/05. <br /> On 7/22/05, EHD Frank Girardi received phone call from Albert Vaccarezza, He got in <br /> contact w/Padilla(a registered hauler). Tires scheduled to be removed by 8/l/05. <br /> On 8/10/05, Frank Girardi and Robert McClellon conducted a re-inspection. Waste tires <br /> have not been removed. Violations have not been corrected. Photos taken at time of site <br /> visit. Albert V. indicated that "Padilla was too busy to pick up the tires". To be referred <br /> to CIWMB Tire Enforcement. <br /> On 8/23/05, Frank Girardi spoke with Laura Niles (CIWMB), she will investigate history <br /> of operator. <br />
