WASTE DISCHARGE REQUIREMENTS <br /> CITY OF LODI <br /> WHITE SLOUGH WATER POLLUTION CONTROL PLANT <br /> SAN JOAQUIN COUNTY -4- <br /> 21 . The State Water Resources Control Board adopted Order No. 91-13-DWQ <br /> (General Permit No. CAS000001) specifying waste discharge requirements for <br /> discharges of storm water associated with industrial activities, excluding <br /> construction activities, and requiring submittal of a Notice of Intent by <br /> industries to be covered under the permit. This Order further specified <br /> that if an individual permit is adopted for storm water runoff from a <br /> facility, then the General Permit would no longer apply. This individual <br /> permit and the provisions it contains concerning stormwater relieves the <br /> Discharger from seeking coverage under the General Permit. <br /> CEQA <br /> 22. The action to adopt an NPDES permit is exempt from the provisions of the <br /> California Environmental Quality Act (Public Resources Code Section 21000, <br /> et seq. ) , in accordance with Section 13389 of the California Water Code. <br /> 23. San Joaquin County has certified a final environmental impact report (EIR) <br /> and a supplemental EIR in accordance with the California Environmental <br /> Quality Act (Public Resources Code Section 21000, et seq. ) , and the State <br /> Guidelines. The project may have the following significant impacts on <br /> water quality: <br /> a. Potential contamination of groundwater or Interstate 5 borrow pits with <br /> nitrogen compounds and other pollutants if agronomic rates of effluent <br /> and sludge application are exceeded on the City-owned agricultural <br /> fields. <br /> b. Potential health hazard for full water contact recreationists in <br /> Dredger Cut. <br /> c. Potential decrease of dissolved oxygen in White Slough and Bishop Cut <br /> due to an increase in pollutants (BOD and suspended solids) discharged. <br /> 24. The Board has reviewed the EIR and Supplemental EIR, and these waste <br /> discharge requirements will mitigate or avoid the significant impacts on <br /> water quality listed in Finding 23. <br /> PUBLIC HEALTH AND CHRONIC TOXICITY <br /> 25. Effluent limits in this permit for disinfection and chronic toxicity are <br /> based on existing flow regimes in Dredger Cut, Bishop Cut, and White <br /> Slough. The existing data include a single determination of dilution over <br /> a tidal cycle, which may not be an accurate representation of available <br /> dilution during different seasons, at the higher flow rates allowed in this <br /> Order, or may not take into account irrigation pumping on Dredger Cut. The <br /> data indicated the average dilution over a 25-hour tidal cycle at the inlet <br /> to Dredger Cut to be 10:1, and in Bishop Cut to be greater than 20: 1, with <br /> effluent flows from the treatment plant at 6 mgd. This Order requires <br /> further dilution studies be conducted to verify if original estimates are <br /> correct. <br />
