1. 3 Jurisdiction. This Order is issued by the Department <br /> to Respondents jointly and severally pursuant to California <br /> Health and Safety Code Section 25355. 5 (a) (1) (C) . <br /> Respondents acknowledge the Department's jurisdiction and waive <br /> any right they may have to a hearing or determination prior to the <br /> issuance of this Order. <br /> 1. 4 Exhibits. All Exhibits attached to this Order are <br /> incorporated herein by this reference. <br /> 1. 5 Purpose. In entering into this Order, it is the <br /> objective of the parties to ensure that any release or threatened <br /> release of a hazardous substance to the air, soil , surface water <br /> and ground water at or from the Site is thoroughly investigated <br /> and appropriate remedial actions are taken. <br /> 1. 6 Denial of Liability. Respondents' consent to the <br /> issuance of this Order shall not be construed as an admission of <br /> any liability for the conditions at the Site. Nothing in this <br /> paragraph is intended or shall be construed to limit the <br /> Department' s right to enforce this Order through appropriate <br /> proceedings. <br /> II. STIPULATED FACTS <br /> 2 . 1 Respondents. <br /> (a) Robert E. Kupka, the current property owner, <br /> purchased the Site in 1981 from Lodi Airport Corporation, now <br /> bankrupt, who purchased the property in 1977 . <br /> -2- <br />
