December 20, 2018 <br /> MEMORANDUM <br /> TO: Planning Commissioners <br /> FROM: Stephanie Stowers, Senior Plannefy�� <br /> SUBJECT: 7609 Northland Road, Manteca (APN: 206-060-19) <br /> Background <br /> At the November 15,2018 Planning Commission hearing, David Tian spoke during public comment <br /> regarding truck parking at 7609 Northland Road, Manteca(APN: 206-060-19), a parcel adjacent to <br /> his property containing his residence. He stated that his neighbor was running a diesel truck stop <br /> with trucks idling at all hours of the day. As a result of his comments, Chair Walker directed the <br /> Community Development Department to prepare a report on the parcel. <br /> On November 21,2018, Corinne King, Counter Manager, and Stephanie Stowers, Senior Planner, <br /> met with two (2) neighboring property owners of 7609 Northland Road, David Tian and Stewart <br /> Gesler. They stated concerns regarding the noise, hours of operation, operation of refrigeration <br /> trailers, STAA trucks being driven on a route not approved for STAA trucks, and the number of <br /> trucks parked on site. During this meeting, the Agricultural Truck Parking use type was discussed <br /> at length, and a detailed discussion regarding this use type is contained in this report. <br /> Parcel &Enforcement History <br /> The subject parcel, 7609 Northland Road, Manteca (APN: 206-060-19), is a two (2) acre parcel <br /> located on the north side of Northland-Road, 1.2 miles east of State Route 99 East Frontage Road, <br /> north of Manteca. The property has a general Plan Designation of A/G (General Agriculture) is <br /> zoned AG-40 (General Agriculture, 40-acre minimum). <br /> Between January and March of 2016, six (6) complaints were entered into the Community <br /> Development Department Enforcement system for truck parking without a land use permit. <br /> Enforcement Case No. EN-1600032 was opened on February 17, 2016, for the above-mentioned <br /> complaints. A Code Enforcement Officer inspected the site on March 30, 2016, and all trucks had <br /> been removed, and as a result, Code Enforcement Case No. EN-1600032 was closed on this date. <br /> The property owner applied for Site Approval application No. 1600172 on July 11, 2016 for <br /> Agricultural Truck Parking for one (1) truck and two (2) trailers. On November 16, 2016, the <br /> Community Development Department approved the Site Approval application. On September 18, <br /> 2016 the property owner applied for Building Permit No. BP-1703692 for grading for an agricultural <br /> truck parking facility. The Building Permit received a final inspection on November 17, 2017, and <br /> with this approval, the Agricultural Truck Parking use was established for a maximum of one (1) <br /> truck and two (2)trailers. <br /> No Code Enforcement complaints were received in 2017. <br /> In 2018, nine (9) complaints were entered into the Community Development Department <br /> Enforcement system regarding STAA trucks being parked on site, the number of trucks being <br /> parked on site, and noise. The complaint regarding STAA trucks parked on site is not a code <br /> violation of either the Building Code or Development Title, but rather involves possible violations <br /> occurring within the public right of way.Therefore, this complaint was forwarded to the Department <br /> of Public Works for review. As a result of the complaint regarding the number of trucks parked on <br /> site, Code Enforcement Case No. EN-1800461 was opened on October 31, 2018. This <br /> Enforcement Case was for"violation of existing land use permit by parking more than one(1)truck <br />
