Defendant shall not permit an employee to provide labor or services 5 relating to the storage or disposal of hazardous waste if the employee has not 6 received the required training, or more than one year has elapsed since the employee 7 was last trained, as required by California Code of Regulations, title 22, section 8 66265.16. 9 4.4.b.3. With regard to Party City Facilities: 10 a. Defendant shall maintain a copy of the Training Roster evidencing 11 each store management personnel's and each permanent employee's 12 training at each Party City Facility within fourteen days (14) from the 13 start of employment in that position. Such records shall be maintained 14 where the employee provides any labor or services, or in the case of 15 an employee who provides labor or services for more than one 16 location, at the employee's primary work location, to be designated 17 by Defendant, for a period of five(5) years from the date the training 18 was conducted, regardless of the duration of the employee's 19 employment. In the event that the Training Rosters are not available 20 during a governmental inspection, Defendant shall provide the 21 Training Rosters to the inspector by the close of the following 22 business day. 23 b. Defendant shall review the Training Roster on a quarterly basis to 24 ensure each employee at the Party City Facility has received the 25 training required under California Code of Regulations, title 22, 26 section 66265.16, and that less than one year has elapsed since the 27 employee last received the required training. 28
