This documentation is referred to here as the "Training <br /> 3 <br /> Roster(s)." <br /> 4 <br /> 4.4.b.2. Defendant shall not permit an employee to provide labor or services <br /> 5 <br /> relating to the storage or disposal of hazardous waste if the employee has not <br /> 6 <br /> received the required training, or more than one year has elapsed since the employee <br /> 7 <br /> was last trained, as required by California Code of Regulations, title 22, section <br /> 8 <br /> 66265.16. <br /> 9 <br /> 4.4.b.3. With regard to Party City Facilities: <br /> 10 <br /> a. Defendant shall maintain a copy of the Training Roster evidencing <br /> 11 <br /> each store management personnel's and each permanent employee's <br /> 12 <br /> training at each Party City Facility within fourteen days (14) from the <br /> 13 <br /> start of employment in that position. Such records shall be maintained <br /> 14 <br /> where the employee provides any labor or services, or in the case of <br /> 15 <br /> an employee who provides labor or services for more than one <br /> 16 <br /> location, at the employee's primary work location, to be designated <br /> 17 <br /> by Defendant, for a period of five(5) years from the date the training <br /> 18 <br /> was conducted, regardless of the duration of the employee's <br /> 19 <br /> employment. In the event that the Training Rosters are not available <br /> 20 <br /> during a governmental inspection, Defendant shall provide the <br /> 21 <br /> Training Rosters to the inspector by the close of the following <br /> 22 <br /> business day. <br /> 23 <br /> b. Defendant shall review the Training Roster on a quarterly basis to <br /> 24 <br /> ensure each employee at the Party City Facility has received the <br /> 25 <br /> training required under California Code of Regulations, title 22, <br /> 26 <br /> section 66265.16, and that less than one year has elapsed since the <br /> 27 <br /> employee last received the required training. <br /> 28 <br />
