Title 22, California Code of <br /> Regulations (Cal . Code. Regs. ) , section 67450 .13 (a) (8) , <br /> requires businesses to submit documentation showing <br /> compliance with the financial assurance requirements to the <br /> Department of Toxic Substances Control (DTSC) and a <br /> Certified Unified Program Agency (CUPA) , by January 1, 1997 . <br /> This documentation consists of a Certification of Financial <br /> Assurance for Permit by Rule and Conditional Authorization <br /> Operations (DTSC Form 1232) with the appropriate financial <br /> assurance documents . <br /> On September 11, 1996, a request to submit the required <br /> financial assurance documentation was initially mailed out <br /> by DTSC to all active PBR and CA businesses. Again, on <br /> January 5, 1998, an advisory letter was mailed out by DTSC <br /> to all PBR and CA businesses and gave 60 days to submit the <br /> required financial assurance documentation. As of <br /> May 11, 1998, DTSC had not received any financial assurance <br /> documentation for closure of your PBR or CA treatment <br /> unit (s) . <br /> DTSC has determined that you violated Title 22, Cal. <br /> Code Regs . , section 67450 . 13 (a) (8) , in that since <br /> January 1, 1997, you failed to submit to DTSC and to a CUPA <br /> the financial assurance documentation for the estimate costs <br /> of closing your PBR or CA treatment unit (s) . <br />
