Report of Violation <br /> June 8, 1998 <br /> Page 2 <br /> Schedule of Compliance <br /> You must correct the above violation by submitting to <br /> this office and your designated CUPA within thirty (30) days <br /> of receipt of this letter the following: <br /> 1. A written cost estimate itemizing each closure <br /> activity; <br /> 2. The financial documents to satisfy the <br /> requirements of financial assurance for closure <br /> costs. The financial documents should be in the <br /> form of a trust fund, surety bond, letter of <br /> credit, closure insurance, financial <br /> test/corporate guarantee, or alternative <br /> mechanism; and <br /> 3 . A Certification of Financial Assurance for PBR and <br /> CA Operations (DTSC Form 1232) . <br /> If you meet the conditions of Title 22 , Cal. Code. <br /> Regs. , section 67450. 13 (d) [closure cost estimate does not <br /> exceed $10, 000] , or section 67450. 13 (e) [facility's PBR unit <br /> operated no more than 30 days in any calendar year] , you are <br /> not required to submit financial assurance documents, but <br /> only the DTSC Form 1232 and the closure cost estimate. <br /> This Report of Violation (ROV) is the first step in <br /> DTSC's formal enforcement process. The issuance of the ROV <br /> does not preclude DTSC from taking further enforcement <br /> action as a result of the violation. Failure to comply with <br /> the financial assurance requirement could subject your <br /> facility to an enforcement action with penalties up to <br /> $25, 000 per day, or revocation of your facility' s <br /> authorization. - <br /> If you have any questions regarding this ROV, please <br /> contact Mr. Nabil H.
