Mr. Dennis Zaragoza - 2 - October 15, 2007 t <br /> Public Notice Process. <br /> 1. The Regional Water Board requires that two separate documents be provided. The first <br /> document will be the draft RAP Fact Sheet. The second document will be a stand <br /> alone, draft final RAP, which may become a final RAP after the 30 day public comment <br /> period, and if all questions or concerns submitted during that period can be addressed <br /> without future revisions. <br /> 2. Once the Regional Water Board has concurred with the draft RAP Fact Sheet, the RAP <br /> Fact Sheet can be finalized, and the 30-day public comment period should begin. The <br /> Fact Sheet should be public noticed in the local newspaper, and distributed to the <br /> surrounding businesses and residences. The Regional Water Board concurs with the <br /> preferred manner for distributing the Final Fact Sheet, which is hand delivery to <br /> surrounding businesses and residences within a two-block radius of the Site. <br /> 3. The "CLEANUP GOAL" section of both the fact sheet and draft final RAP should <br /> contain the following language: <br /> "Pursuant to Resolution 92-49, the Regional Water Board is required to ensure that the <br /> discharger cleanup to "background" unless that is not reasonable and at minimum <br /> cleanup to the level that is economically and technically feasible and meets water <br /> quality objectives. <br /> This means that in orders issued pursuant to Water Code section 13304, the Regional <br /> Water Board does not typically set forth the final cleanup levels; rather it provides the <br /> discharger with the information about the applicable water quality objectives, but defers <br /> the decision on when to "close" the site based on information provided by the <br /> discharger. In many cases, a site may be closed before it meets the applicable <br /> objectives, where, for example it is not reasonably feasible to achieve more cleanup in <br /> a cost-effective way and the site will naturally degrade or attenuate in a reasonable <br /> time. <br /> 4. On April 27, 2007, the Regional Water Board concurred with the proposal to install one <br /> additional deep monitoring well, and with the proposed location near the corner of E. <br /> Walnut and S. Main. Well installation will begin within the next two weeks, and E2C will <br /> provide the Regional Water Board at least one week notice of the field work <br /> commencement. The deep well installation report can be included with the Fourth <br /> Quarter Groundwater Monitoring Report to be submitted in early 2008. <br /> 5. During the Fourth Quarter Groundwater Monitoring event, the Regional Water Board <br /> will collect a set of split groundwater samples from the Key Monitoring Wells as <br /> described on page 15 of the Pay for performance Contract. <br />
