1 <br /> WASTE DISCHARGE REQUIREMENTS <br /> EL RANCHO ROCK AND SAND, INC. , ET AL. <br /> SAN JOAQUIN COUNTY -4- <br /> 5. The Discharger shall submit and operate under a Site Operations Plan <br /> approved by the Executive Officer. The plan shall include management <br /> of wastewater and solids, including fines, and shall be submitted <br /> within 60 days of the date of this Order. <br /> 6. The Discharger shall submit an annual report, by 30 January of each <br /> year, certifying compliance with these requirements, and specifying <br /> any problems encountered over the past year. <br /> 7. The Discharger shall report promptly to the Board any material change <br /> or proposed change in the character, location, or volume of the <br /> discharge. <br /> 8. Albert Purviance Sr. , Cynthia Ann Purviance, Albert Purviance, Jr. , <br /> Sharyl Christine Purviance, and Victoria Izetta Purviance, as owners <br /> of the real property at which the discharge will occur, are ultimately <br /> responsible for ensuring compliance with these requirements. E1 <br /> Rancho Rock and Sand, Inc. and Inspiration Resources Corp. retain <br /> primary responsibility for compliance with these requirements, <br /> including day-to-day operations and monitoring. Enforcement actions <br /> will be taken against Albert Purviance Sr. , Cynthia Ann Purviance, <br /> Albert Purviance, Jr. , Sharyl Christine Purviance, and Victoria Izetta <br /> Purviance only in the event that enforcement actions against El Rancho <br /> Rock and Sand, Inc. and Inspiration Resources Corp. are ineffective or <br /> would be futile, or that enforcement is necessary to protect public <br /> health or the environment. <br /> 9. In the event of any change in control or ownership of land or waste <br /> discharge facilities presently owned or controlled by the Discharger, <br /> the Discharger shall notify the succeeding owner or operator of the <br /> existence of this Order by letter, a copy of which shall be <br /> immediately forwarded to this office. <br /> 10. The Board will review this Order periodically and may revise <br /> requirements when necessary. <br /> I , WILLIAM H.
