.90095814 <br /> 2 . Expansion of Property. INTENTIONALLY DELETED. <br /> 3 . Use of the Property. Lessee may use the Property <br /> for the purpose of excavating and removing gravel and sand from <br /> the Property and for operations normally associated with such ' <br /> use . In connection with such use, Lessee may maintain upon the <br /> Property such equipment and machinery as may be used in the <br /> excavation and removal of such sand and gravel . Lessee may <br /> maintain structures suitable for its office and the residence of <br /> a caretaker . Owner and Lessee acknowledge that an excavation <br /> permit ( "Excavation Permit" ) has been issued by San Joaquin <br /> County permitting the party who is entitled to use and possession <br /> of the Property to excavate, process , stockpile and remove soil, <br /> sand, gravel and rock from the Property in accordance with the <br /> conditions imposed by the Permit . <br /> 4 . Term. The term of this Lease shall be for a <br /> period of five ( 5 ) years commencing on October 1 , 1980 and <br /> terminating on October 1 , 1985 . At the expiration of the <br /> original term of this Lease, Lessee may extend the term of this <br /> Lease on all the provisions contained in this Lease for three ( 3 ) <br /> successive extended terms of ten ( 10 ) years each by giving Owner <br /> written notice of its intention to do so at least ten ( 10 ) days <br /> prior to the expiration of the original term or of any extended <br /> term resulting from the exercise of the option to extend. <br /> 5 . Rental . By way of rental, Lessee shall pay to <br /> Owner the total. of the following sums effective as of the date <br /> first set forth above: <br /> 763004 . 2920 -3- JSJ <br /> 081690 092190 <br />
