6 <br /> ti <br /> CONDITIONS OF APPROVAL <br /> MS-98-39 <br /> Hamatani <br /> Minor Subdivision Application No. MS-98-39 was approved by the San Joaquin County Community <br /> Development Department on December 24, 1998. The effective date of approval is January 3, 1999. <br /> This tentative map approval will expire on January 2, 2002, which is three years from the effective <br /> date of approval,unless(1) all Conditions of Approval have been complied with and (2)a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 60 feet, measured at the front yard <br /> setback line. (Development Title Section 9-310.4) <br /> (2) All parcels shall have a minimum lot area of 6000 square feet. (Development Title <br /> Section 9-310.3) <br /> (3) All new lot lines shall respect a 5-foot side yard setback requirement. <br /> b. LANDSCAPING: Landscaping shall be provided and comply with the following: <br /> (1) Street trees are required as specified in Section 9-1020.4 of the Development Title. <br /> C. AVIGATION EASEMENT: An avigation easement shall be recorded in favor of the <br /> Stockton Metropolitan Airport. (DevelopmentTitle Section 1610.8[aj) <br /> 2. PARK FEES: Due to the relatively small size of the subdivision,less than fifty(50) parcels, <br /> the San Joaquin County Departmentof Parks and Recreation will require the collectionof in- <br /> lieu fees for park development as a requirement for approval of the Map. (Development <br /> Title Section 9-1230.8) <br /> 5. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers,and employees from any claim,action,or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision,which <br /> action is brought within the time provided forin Section 66499.37 of the Government Code. <br />
