6 ti CONDITIONS OF APPROVAL MS-98-39 Hamatani Minor Subdivision Application No. MS-98-39 was approved by the San Joaquin County Community Development Department on December 24, 1998. The effective date of approval is January 3, 1999. This tentative map approval will expire on January 2, 2002, which is three years from the effective date of approval,unless(1) all Conditions of Approval have been complied with and (2)a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified,and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Chandler Martin,468-3144) a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: (1) All parcels shall have a minimum lot width of 60 feet, measured at the front yard setback line. (Development Title Section 9-310.4) (2) All parcels shall have a minimum lot area of 6000 square feet. (Development Title Section 9-310.3) (3) All new lot lines shall respect a 5-foot side yard setback requirement. b. LANDSCAPING: Landscaping shall be provided and comply with the following: (1) Street trees are required as specified in Section 9-1020.4 of the Development Title. C. AVIGATION EASEMENT: An avigation easement shall be recorded in favor of the Stockton Metropolitan Airport. (DevelopmentTitle Section 1610.8[aj) 2. DEPARTMENT OF PUBLIC WORKS (See the attached memo dated December 15, 1998.) 3. PUBLIC HEALTH SERVICES (Seethe attached memo dated November 30, 1998.) 4. DEPARTMENT OF PARKS AND RECREATION (Staff Contact: Jeff Smith, 953-8800) a. PARK FEES: Due to the relatively small size of the subdivision,less than fifty(50) parcels, the San Joaquin County Departmentof Parks and Recreation will require the collectionof in- lieu fees for park development as a requirement for approval of the Map. (Development Title Section 9-1230.8) 5. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers,and employees from any claim,action,or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision,which action is brought within the time provided forin Section 66499.37 of the Government Code.
