Item No. 4 <br /> PLANNING COMMISSION MINUTES <br /> DECEMBER 20, 1984 <br /> 9 . MODIFICATION OF CONDITIONS OF EXCAVATION PERMIT NO. EP-81-9 <br /> OF ROSS PURVIANCE (C/O STOCKTON SAND AND GRAVEL) , to expand an <br /> existing quarry excavation from 712,000 cubic yards (46. 5 acres ) <br /> to 1, 025, 000 cubic yards (67.1 acres ) , for property located on <br /> the east side of Waverly Road, approximately one-half mile south <br /> of Shelton Road, east of Linden. <br /> Planner Harry Islas introduced a staff report into the record. <br /> Mr. Islas noted that while the applicant is requesting excavation <br /> to hardpan, they will still establish a final grade that will <br /> generally be no more than a 5% variation from one end to the <br /> other of the property. <br /> Mr. Davisson noted that this is a permit to modify conditions <br /> approved by the Board of Supervisors. Mrs. Affonso commented <br /> that in this case the Planning Commission action would be a <br /> recommendation to the Board of Supervisors, depending upon the <br /> Resolution of the Board. <br /> Local Health District submitted conditions as listed in their <br /> letter of December 19, 1984. <br /> Department of Public Works noted that the faithful performance <br /> bond on file is for $50,000, and this amount should be increased <br /> to $75, 000 based on the expansion of the permit. <br /> Mr. Islas noted the proposed modification of the conditions as <br /> outlined in the staff report. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Sharon Bianchini was present for this application. <br /> She said that it was very difficult to obtain the bond and she <br /> objected to the requirement of increasing the bond. She felt <br /> that the present amount of the bond was sufficient to cover the <br /> expansion of the permit. She spoke on the rehabilitation of the <br /> property and said this is proceeding as planned. To comply with <br /> the requirement of the sound barrier, they maintain a distance of <br /> 1, 320 ' from the residence. <br /> Mrs. Bianchini said they propose to excavate down to the hardpan; <br /> that this is an old mining area and the level is uneven. However, <br /> when they are finished with the excavation the grade will be <br /> even. They will level it off. Regarding condition 23 , they <br /> agree that they do not need to have that condition modified as <br /> long as they can work something out with the Planning Department. <br /> She said that screening has been a problem.
