She <br /> questioned the condition that there be no equipment placed east <br /> of the existing structure. She said they want to locate their <br /> equipment around the existing trommel. As to the soil, she said <br /> this is nothing but rocks. <br /> Samuel Everett, 80008 Waverly Road, was present and said he is <br /> trying to save the existing trees and this has been a problem. <br /> He does not wish to have more trees as they block his view. He <br /> wants to preserve the view from his home. The location of the <br /> equipment will not be a problem. He said he is hard of hearing <br /> and the noise of the equipment will not be a problem. He had no <br /> objection to allowing equipment west of the existing structure. <br /> OPPONENTS: None <br /> PUBLIC HEARING CLOSED <br /> Mr. Blevins explained that the bond should be increased to cover <br /> the increased area. If the excavator can submit a rehabilitation <br /> plan with the cost, it is possible that the figure could be less <br /> than $75, 000. <br /> Mr. Islas pointed out that the bond was by increments and phases. <br /> Mrs. Bianchini said she wanted only a standard bond requirement. <br /> Mr. Blevins noted that the bond could be based on the cost of <br /> rehabilitation. Mr. Davisson referred to the wording in the <br /> ordinance requiring the bond to be equal to the estimated cost of <br /> rehabilitation of the property. Mrs. Bianchini and Mr. Blevins <br /> were agreeable to this wording. <br /> MOTION: Moved, seconded (Gillispie-Giambruno) and carried by a <br /> unanimous roll call vote to adopt a Negative Declaration and <br /> recommend to the Board of Supervisors approval of the project <br /> based on the staff report findings and subject to the conditions <br /> listed in the staff report as stated "Proposed Modifications of <br /> Conditions: # ' s 1, 2, 3, 4, and 7, " with a change in condition <br /> #2, as follows, and to add conditions as follows: <br /> 2 . All proposed excavation and rehabilitation shall be <br /> completed prior to expiration of this permit in accor- <br /> dance with the revised Excavation and Rehabilitation <br /> Schedule, dated December 11, 1984, submitted as part of <br /> the proposed modification. <br /> The amount of the performance guarantee shall be suf- <br /> ficient to cover the cost of rehabilitation; and the <br /> amount of such guarantee shall be determined by the <br /> Department of Public Works. <br />
