Am pm 83333 550 W Valpico Rd, Tracy October 30, 2014 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 601 CCR 66262.34(d) Stored hazardous waste onsite greater than 180 days. <br /> Three 55-gallon metal containers were observed inside the hazardous waste storage area. The first container of <br /> commingled diesel and gasoline filters had an accumulation start date of 12/4/2012. The second container, labeled <br /> "Used oil and gasoline filters", lacked an accumulation start date. Furthermore, due to the restricted access no label <br /> was observed on the third 55-gallon container. Facilities who generate less than 1000 kg of hazardous waste per month <br /> and do not exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. Immediately <br /> contact a licensed hazardous waste hauler to dispose of these wastes under manifest and submit a copy of the <br /> manifest to the EHD. This is a Class II violation. <br /> 605 CCR 66262.34(f) Failed to completely label containers or tanks of hazardous waste. <br /> At least one of the observed 55-gallon container located inside the hazardous waste storage area north of the store <br /> lacked an appropriate label. All hazardous waste containers shall be marked with the following information: <br /> -the words "Hazardous Waste" <br /> - name and address of generator <br /> - hazardous properties <br /> - physical state <br /> - composition (contents) <br /> - accumulation start date <br /> Immediately label all hazardous waste containers and ensure that all containers are marked with all the required <br /> information. Since it cannot be determined how long these containers has been on site, immediately contact a licensed <br /> hazardous waste hauler to dispose of this waste under manifest and submit a copy of the manifest to the EHD. This is <br /> a Class II violation. <br /> Overall Inspection Comments: <br /> A CHECKLIST OF FINDINGS WAS LEFT ONSITE AT THE TIME OF INSPECTION; A COMPLETE REPORT <br /> WAS ISSUED ON NOVEMBER 4, 2014. <br /> -Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, 30 days from the receipt of this inspection report. <br /> -Consent to perform the inspection, take photos and collect samples was given by Kevin Piper, store manager. <br /> -This facility generated 0.42 tons of waste in the last calendar year (Jan-Dec). <br /> -Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information <br /> online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov.
