FINDINGS FOR DEVIATION <br /> PA-1900082 <br /> JOHN AND MARY LYNNE FRANZIA/LATITUDE 37 PARTNERS, LLC. <br /> 1. The granting of the Deviation will not be materially detrimental to other property or land uses in the area; <br /> • This finding can be made because the proposed winery begins approximately 150-feet from <br /> the applicant's front property line which will provide a buffer along East State Route 120 <br /> California Highway. The surrounding land uses include primarily agriculture and scattered <br /> residences and the proposed development will be consistent with the surrounding land uses. <br /> The project is not located along a scenic route or view. <br /> 2. There are exceptional or extraordinary circumstances or conditions applicable to the property or to the <br /> intended uses that do not apply to other properties in the same zoning district in the vicinity. <br /> • This finding can be made because the property has special circumstances related to the <br /> location of the existing structures and orchard.Although the parcel is 44.62 acres,the existing <br /> structures to be utilized for the project are set back 150 feet from the front property line. The <br /> majority of the property is planted in orchards, and also contains a single family residence <br /> and accessory buildings. The request for a reduced setback is to allow the proposed small <br /> winery to utilize the existing structures. This area is relatively flat. Due to the location of the <br /> existing orchard structures,the location for the small winery is limited. <br /> 3. The strict application of the regulation deprives the property of privileges enjoyed by other properties in <br /> the vicinity. <br /> • This finding can be made because the strict application deprives the property owner from <br /> developing the property while maintaining the required setbacks. Development Title Section <br /> 9-824.2(a)(2) allows up to a forty percent (40%) reduction of the required side yard setback <br /> and Development Title Section 9-824.2(a)(3) allows up to a thirty percent (30%) reduction in <br /> the required rear yard setback without a public hearing, and this Deviation request meets <br /> the requirements. <br /> 4. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the proposed project may be conditionally permitted in <br /> the AG40 (General Agriculture40 acre minimum) zone with an approved Use Permit <br /> application. The winery expansion is also consistent with the goals, policies,standards and <br /> maps of the General Plan. The project must meet the noise ordinance requirements of sixty <br /> five (65) dB at the property line.
