r <br />(1) Wastes may remain exposed after completion of <br />closure; or <br />(2) Short term, incidental access by the public or <br />domestic livestock may pose a hazard to human health. <br />(c) Post -closure use of the property on or in which hazardous <br />waste remains after closure shall never be allowed to <br />disturb the integrity of the final cover, liner(s), or <br />any other components of any containment system, or the <br />function of the facility's monitoring systems, unless the <br />owner or operator can demonstrate to the California <br />Regional Water Quality Control Board either in the post - <br />closure plan or by petition, that the disturbance: <br />(1) Is necessary to the proposed use of the property, <br />and will not increase the potential hazard to human <br />health or the environment; or <br />(2) Is necessary to reduce a threat to human health or <br />the environment. <br />(d) The owner or operator shall provide <br />post -closure care in accordance with the approved post -closure <br />plan for at least 30 years after the date of completing closure. <br />However, the owner or operator may petition the California <br />Regional Water Quality Control Board to allow some or all of <br />the requirements for post -closure care to be discontinued or <br />altered before the end of the 30 -year period. The petition <br />shall include evidence demonstrating the secure nature of the <br />facility that makes continuing the specified post -closure <br />requirement(s) unnecessary (e.g., no detected leaks and none <br />likely to occur, characteristics of the waste, application of <br />advanced technology, or alternative disposal, treatment, or <br />re -use techniques ). Alternately, the California Regional <br />Water Quality Control Board may require the owner or operator <br />to continue one or more of the post -closure care and maintenance <br />requirements contained in the facility's post -closure plan for <br />a specified period of time. The California Regional Water <br />Quality Control Board may do this if they find there has been <br />noncompliance with any applicable standards or requirements, <br />or that such continuation is necessary to protect human health <br />or the environment. At the end of the specified period of time, <br />the California Regional Water Quality Control Board will <br />determine whether to continue or terminate post -closure care <br />and maintenance at the facility. The owner or operator may <br />petition the California Regional Water Quality Control Board <br />for an extension or reduction of the post -closure care period <br />based on cause. These petitions will be considered by the <br />California Regional Water Quality Control Board at the time <br />the post -closure plan is submitted and at five-year intervals <br />after the completion of closure. <br />
