rA <br />:3.1 <br />7. Notice in deed to property. <br />_The owner of the property on which the facility is located shall <br />record, in accordance with California law, a notation on the <br />deed to the facility property --or on some other instrument which is <br />normally examined during title search --that will in perpetuity <br />notify any potential purchaser of the property that: (1) the land <br />has been used to manage hazardous waste, and (2) its use is <br />restricted under Item 4(c). <br />8. Cost estimate for post -closure monitoring and maintenance. <br />(a) The owner or operator shall have a written estimate of the <br />annual cost of post -closure monitoring and maintenance of <br />the facility. The owner or operator shall keep this estimate, <br />and all subsequent estimates required in this Item, at the <br />facility. <br />(b) The owner or operator shall prepare a new annual post - <br />closure cost estimate whenever a change in the post -closure <br />plan affects the cost of post -closure care. The latest <br />post -closure cost estimate is calculated by multiplying the <br />latest annual post -closure cost estimate by 30. <br />(c) Annually during the operating life of the facility, the owner <br />or operator shall adjust the latest post -closure cost estimate <br />using the inflation factor calculated as described elsewhere <br />in this document. The adjusted post -closure cost estimate <br />shall equal the latest post -closure cost estimate times the <br />inflation factor. <br />
