U ' <br />JO <br />-7,4(a <br />CONDITIONS)/HAZARD(S) TO BE SECURED: (J fig <br />(16-fK ot? 6l2 Q <br />UNIOC <br />Iv jN !XVQ <br />COMPLIANCE DATE: <br />NOTICE IS HEREBY GIVEN THAT AN UNSAFE, UNSECURED, AND/OR HAZARDOUS CONDITION(S) HAS BEEN <br />IDENTIFIED ON THE ABOVE NOTED PROPERTY AND IS HEREBY DECLARED A PUBLIC NUISANCE. <br />VIOLATION <br />As specified in San Joaquin County Ordinance (SJC Ordinance), the existence of an unsafe condition on a property <br />that is not secured from access by the general public is considered a public nuisance. In addition, the existence of <br />an unsecured structure, open well, open septic tank, excavation or other hazardous condition which may affect the <br />health and safety of any person or domestic animal is also a public nuisance (SJC Ordinance, Section 8-5600). It <br />is a violation for any property owner to permit or maintain a nuisance on his property (SJC Ordinance, Section 8- <br />5100;California Health and Safety Code, Section 17920.3(c)). <br />ORDER TO SECURE OR ABATE <br />Within ten (10) calendar days, the unsafe conditions identified above must be secured through boarding up <br />of open structures, providing fencing, installing an approved covering on an open well casing, providing suitable <br />covering for an open septic tank or other excavation and any other means to protect public health and safety as <br />determined by the Environmental Health Department. Securement must be sufficient to disallow entry by <br />unauthorized persons and must be maintained securely at all times (SJC Ordinance, Sections 8-5600, 8-5605). <br />UNLAWFUL NOT TO SECURE AFTER NOTICE <br />It is unlawful for any owner, agent, lessee or person having charge or control of any unsecured, unsafe property <br />condition within the unincorporated area of San Joaquin County to refuse or neglect to secure said unsafe <br />condition, hereinbefore declared to be a public nuisance, after notice from the enforcement agency (SJC <br />Ordinance, Section 8-5601). <br />ENFORCEMENT AND COST RECOVERY <br />Failure to secure the unsafe condition(s) within ten calendar days may cause San Joaquin County to have such <br />securement completed (SJC Ordinance, Section 8-5606). The cost of securement, including contracted cost to <br />secure, to investigate the ownership of and beneficial interest in the subject property, and to reimburse staff time <br />shall be the responsibility of the legal property owner (SJC Ordinance, Section 8-5608). Securement costs not paid <br />will result in a special tax assessment on the property. A Notice of Abatement Action will be recorded with the <br />Office of the Recorder and shall not be removed until all violations are abated and all costs have been paid (SJC <br />Ordinance, Section 8-5603).
