Main St. <br /> Stockton,CA.,95202 <br /> In a meeting held at San Joaquin County Public Health Services, Environmental Health Division <br /> (PHS-EHD) on January 12, 1999,Mr. Frank Enright assured the City of Stockton representative and <br /> PHS-EHD that he would be submitting a document concerning ownership of an abandoned <br /> underground storage tank(UST) at the northeast corner of the site. This document was to be <br /> submitted to PHS-EHD by March 1, 1999 and as of this date, has not been received. <br /> On March 9, 1999,PHS-EHD directed you to submit a work plan to define the groundwater <br /> contamination by April 14, 1999. The work plan has not been received at PHS-EHD. <br /> Additionally,a UST Closure Plan and fees were to be submitted to PHS-EHD by March 31, 1999 <br /> for the illegally abandoned UST located in the City of Stockton's right of way on Main Street. As of <br /> this date, the UST Closure Plan has not been received. <br /> The February 19, 1999 proposal to over-excavate petroleum contaminated soil was not approved by <br /> PHS-EHD on March 9, 1999. In correspondence dated the same day,PHS-EHD notified you that <br /> the over-excavation may proceed at your own expense if you still wanted to proceed and requested <br /> that you acknowledge that the over-excavation of the 825 to 1825 cubic yards of soil was not <br /> directed by PHS-EHD. Your written letter of intention was due by April 14, 1999 and has not been <br /> received. <br /> You are not in compliance with PHS-EHD directives since you failed to submit the work plan, the <br /> UST Closure Plan, and the associated fees. UST sites are required to be in compliance with <br /> directives issued by PHS-EHD in order to become or remain eligible to receive reimbursement from <br /> the State Water Resource Control Board (SWRCB) Clean Up Fund (CUF). Failure to comply with <br /> PHS-EHD directives may also result in a referral to the San Joaquin County District Attorney's <br /> Environmental Prosecutions Unit for formal enforcement. <br /> The failure to submit a UST Closure Plan is being referred to the San Joaquin County District <br /> Attorney's Office for formal enforcement action. <br /> The SWRCB-CLF allows 90 days for responsible parties to come into compliance with directives <br /> issued by PHS-EHD. This is to notify you that you have until June 9, 1999 (ninety days from <br /> the original directive) to submit a complete work plan, boring permit application, and the <br /> $89 application fee. <br /> A Division of San Joaquin County Hcalrh Care Scrvices <br />
