(EHD) Local Oversight <br /> Program staff has provided-,regulatory oversight of correctiveactions taken to address <br /> subsurface contamination at the: above referenced former .underground storage tank <br /> (UST) site since February 5, .1993. The contamination resulted from an unauthorized <br /> release or releases from the-former UST system. <br /> This site is currently out of.compliance with regulatory directives to complete a remedial <br /> pilot test and to conduct and report routine groundwater monitoring. The EHD considers it <br /> imperative that the remedial pilot testing be conducted and reported to the EHD so that <br /> the _remedial alternative feasibility study can be completed. Conclusions from the <br /> remedial pilot testing would help determine if this action would-be effective at reducing the <br /> concentrations of dissolved petroleum hydrocarbons in the shallow groundwater at the <br /> site. The EHD has been :advised by the last consultant for the responsible party (RP) that <br /> since they,have not been paid for the last investigative phases, they will -not conduct any <br /> additional' remedial or investigative.activities-for the RP until the financial matter has been <br /> settled. <br /> Due to.the responsible party's failure to continue the investigative and remedial phases <br /> required at this site, the EHD is referring this site to you for oversight as the lead <br /> regulatory agency and forenforcement action if appropriate. <br /> If you have any questions please contact Michael Infurna at (209) 468-3454. <br /> Michael Infurna J .
