Main �N�P aE M�JSevj C <br /> Stockton, CA 95201 <br /> Subject: Valley Motors -06) <br /> Status of Aquifer Test b�`� tl � PP <br /> Dear Mr. Infurna: 469, <br /> G}/ <br /> The purpose of this letter is to advise you of the status of the investigation dt <br /> Valley Motors, particularly with regard to the second aquifer test that was scheduled to <br /> take place during the fourth quarter ofd 4Zx� <br /> 441b; <br /> In accordance with the work plan that was dated May 27, 2011, V&W Drilling t ;'9 <br /> installed groundwater extraction well VM-10 on September 30, 2011 under the ( lj <br /> supervision of Upgradient Environmental Consultants. This was done despite the fact that Y <br /> Upgradient had previously informed Valley Motors and the Environmental Health <br /> Department that no additional expenditures would be incurred by Upgradient until <br /> Upgradient had received payment for all outstanding invoices, and as of that date no <br /> payments had been received. That situation has not changed since September 30. <br /> On a number of occasions, Mr. Tom O'Neill of Valley Motors has assured <br /> Upgradient Environmental that he was nearing completion of financial arrangements to <br /> make it possible to pay down a portion of the outstanding balance. Most recently, we <br /> were assured that a loan on the Valley Motors property was imminent and on that basis <br /> we moved forward to install the extraction well. As on earlier occasions, however,that t <br /> funding has not come through and Valle} Motors is still unable to make any payments, t0 l <br /> nor is Mr. O'Neill able to guarantee when payment will be forthcoming. Therefore, we f J <br /> cannot provide EHD with a new estimated date for completion of the test at this time. <br /> The financial status of the investiPt=on at the present time is as follows: <br /> X <br /> Amount previously received by Valley Motors from UST Fund $64,394.76 t0� 4u <br /> but not yet dispersed to Upgradient(includes 2008 loan <br /> from Upgradient to Valley Motors that now totals <br /> $15,978.61): <br /> Amount previously approved for payment to Valley Motors <br /> but not yet paid by UST Fund: 22,986.15. , fit <br /> Amount previously invoiced by Upgradient but not yet _ 'J <br /> ., <br /> approved for payment by UST Fund(for unknown reason): 1, 80.50 t" <br /> 9 <br /> Stockton: P.O.
