Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; <br /> 2. Approve Site Approval No. PA-02-625 based on the Findings and subject to the Conditions <br /> of Approval contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the Veterans Organization use type may be <br /> conditionally permitted in the AG-40 zone with an approved-Site Approval. The site.meets <br /> the criteria of Ordinance No.4181,which requires that the Veteran Organization use type <br /> must be in an existing building in the agricultural zones. The proposed use is consistent <br /> with the AIG General Plan designation. No other plans apply. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the site has an existing well and septic tank. The site is <br /> large enough to accommodate a drainage pond and roadway dedication required by the <br /> Department of Public Works. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the site is relatively level. The property currently has <br /> an existing building on the site, and no new structures are proposed. Additionally,the <br /> property size of 2.81 acres is adequate in size to accommodate the provisions of the <br /> Development Title required in the Conditions of Approval. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts. Additionally,the proposed use will not have <br /> adverse effects on nearby properties because it is large enough to accommodate the use <br /> and required improvements. <br /> 5. The use is compatible with adjoining land uses. <br /> • This finding can be made because, with the Conditions of Approval, the proposed use will <br /> not interfere with or alter the current uses on adjacent agricultural properties. <br /> San Joaquin County PA-02-625\VFW Post 1051 <br /> Community Development Page 4 <br />
