Union Ice is not included under the specific provisions of <br /> this Act because it never petitioned the Site Designation Committee to designate an administering <br /> agency to oversee its site investigation (see H&SC Sections 25261 and 25262). However, the <br /> statements below should achieve the same purpose as an official "Certificate of Completion". <br /> In 1993 the Board issued a self-direction to Union Ice in response to notification that a suspected release <br /> of chromium had occurred from its Stockton facility. Union Ice submitted a Phase I investigation report <br /> in April 1993, and a well construction and sampling report in December 1993. Soil samples and ground <br /> water samples were all within the typical background range. Based on the information provided, Board <br /> staff has determined that no further investigation, remedial action or monitoring is required at this time. <br /> Nothing in this determination shall constitute or be construed as a satisfaction or release from liability <br /> for any conditions or claims arising as a result of past, current or future operations at this location. <br /> Nothing in this determination is intended or shall be construed to limit the rights of any parties with <br /> respect to claims arising out of or relating to deposit or disposal at any other location of substances <br /> removed from the site. Nothing in this determination is intended or shall be construed to limit or <br /> preclude the Board or any other agency from taking any further enforcement actions. <br /> This letter does not relieve Union Ice of any responsibilities mandated under the California Health and <br /> Safety Code and the California Water Code if existing, additional, or previously-unidentified <br /> contamination at the site causes or threatens to cause pollution or nuisance or is found to pose a threat to <br /> public health or water quality.
