California law requires a person to inform the state if a situation is encountered that can be considered an immediate endangerment to the public's health or welfare and/or to the environment. Therefore, the client shall be contractually bound to make said disclosures in lieu of Kleinfelder, its rs"ca-., principals,employees or subcontractors. CLIENT RESPONSIBELMES AND ASSUMPTi NS This proposal and the attached cost estimate are based on the following assumptions and responsibilities: • Adequate workspace and access for sampling equipment (Geoprobe subcontractor) will be provided. Klei,rlfclder will attempt to collect samples at the proposed locations. If the equipment cannot be positioned, alternative excavation or sampling methods should be investigated. • Soil sampling can be conducted in a single day. If more than one day is required, additional costs may be iricunmd. • Soil samples can be collected using the"GeopmW tedWqule. If samples me unable to be collected dere to hardpan soil, grovel etc, different merhods may meed to be used at additional costs. a Soil generated during advancement of the geoprobes will be the rmpoDsibility of the client, • This proposal is based on the presumption that the client will clearly mark utilities and will provide any and all available survey maps or other data to determine the location of existing structuress, underground utilities and services. B&B Equipment Company should be awam that pemet Vd:ng the site's surface is inherently risky. It is impossible to detenmime with certainty the precise location of all structures,which may be buried in the ground. Kleinfelder's fee is not adequate to compensate for both the p"ormance of the services and the assumption of risk of damage to such structures. Disruption of utilities or darnage to underground structures will be the responsibility of B&B Equipment ' Company. Services rendered by Kleinfelder to repair them will be billed at coat. Underground Service Alert (USA) at 1-800-642-2444 provides a partial location service free of charge for major utility lines. It is important that B&B Equipment Company, umlerstand that subsurface utilities buried under private property will not be marked by the public utility companies contacted by USA.
