1 omissions by Respondents, their officers, directors, employees, <br /> 2 agents, receivers, trustees, successors, or of any persons, <br /> 3 including but not limited to, firms, corporations, subsidiaries, <br /> 4 contractors, or consultants in carrying out activities pursuant <br /> 5 to this Order, nor shall the State of California be held as <br /> 6 party to any contract entered into by Respondents or its agents <br /> 7 in carrying out activities pursuant to this Order. <br /> 8 6. 17 RESERVATION OF RIGHTS <br /> 9 Nothing in this Order is intended or shall be construed to limit <br /> 10 the rights of any of the parties hereto with respect to claims <br /> 11 arising out of or relating to the deposit or disposal at any <br /> 12 other location of substances removed from the Site. Nothing in <br /> 13 this Order is intended or shall be construed to limit or pre- <br /> 14 clude the Department from taking any other action authorized by <br /> 15 law to protect the public health and welfare or the environment <br /> 16 and recovering the costs thereof. <br /> 17 6. 18 SEVERABILITY <br /> 18 The requirements of this Order are severable, and Respondents <br /> 19 shall comply with each and every provision hereof notwithstand- <br /> 20 ing the effectiveness of any other provision. <br /> 21 6. 19 PARTIES BOUND <br /> 22 This Order applies to and is binding upon Respondents, their <br /> 23 directors, officers, agents, employees, contractors, and their <br /> 24 successors and assigns. <br /> 25 6.20 EFFECTIVE DATE <br /> 26 The effective date of this Order is the date of signature <br /> 27 by the Department. <br /> COURT PAPER <br /> STATE OF GUFCRNIA -17- <br /> STD. 113 IREV.
