1 related to this Order; reviewing the progress of Respondents in <br /> 2 carrying out the terms of this Order; conducting such tests as <br /> 3 the Department may deem necessary; and verifying the data <br /> 4 submitted to the Department by Respondents. Nothing in this <br /> 5 paragraph is intended or shall be construed to limit in any way <br /> 6 the right of entry or inspection that the Department or any <br /> 7 other agency may otherwise have under law. <br /> 8 6. 13 SAMPLING DATA AND DOCUMENT AVAILABILITY <br /> 9 Respondents shall permit the Department and/or its authorized <br /> 10 representatives to inspect and copy all sampling, testing, <br /> 11 monitoring or other data generated by Respondents or on Res- <br /> 12 pondents' behalf in any way pertaining to work undertaken pur- <br /> 13 suant to this Order. Respondents shall allow duplicate sam- <br /> 14 ples to be taken by the Department and/or its authorized re- <br /> 15 presentatives, of any samples collected by Respondents pursuant <br /> 16 to this Order. <br /> 17 6. 14 ADDITIONAL ENFORCEMENT ACTIONS <br /> 18 By entering into this Order, the Department does not waive any <br /> 19 further enforcement actions. <br /> 20 6. 15 COMPLIANCE WITH APPLICABLE LAWS <br /> 21 Respondents shall carry out this Order in compliance with <br /> 22 all applicable local, State, and Federal requirements, includ- <br /> 23 ing, but not limited to, requirements to obtain permits and to <br /> 24 assure worker safety. <br /> 25 6. 16 GOVERNMENT LIABILITIES <br /> 26 The State of California shall not be liable for any injuries <br /> 27 or damages to persons or property resulting from acts or <br /> COURT PAPER <br /> STATE OF CALIFORNIA -16- <br /> STD. 113 (REV. 8 731 V <br /> 85 34709 <br />
