2. SITE HISTORY SUMMARY/PHASE I ESAs
As indicated above, TRE conducted five Phase I ESAs in accordance with the American
Society for Testing and Materials (ASTM) guidelines: Standards on Environmental Site
Assessments for Commercial Real Estate (El527-00) and the All Appropriate Inquiries
regulations (AAI) as contained in 40 CFR, §312.1 through 31 (both of these guidelines
and requirements have now been combined and published in ASTM El527-05) with
noted exceptions and limitations contained in the Phase I ESA reports. The AAI rule,
which has been recently mandated by the EPA became effective on November 1, 2006,
hence the Phase I ESA report has been prepared to conform to the AAI and ASTM
E1527-00.
The findings and conclusions of the Phase I ESA for each and every parcel as
summarized below:
APN: 157-002-02: 2731 E Myrtle St: Sadree Corp: TRE conducted a commercially
responsible due diligence review (with noted limitations) of the 2731 E Myrtle Street,
Stockton, CA for the purpose of identifying recognized environmental condition. Based
on TRE's review of the information, there does not appear to be any recognized
environmental conditions associated with this property.
However, based on TRE's site visits/interviews (from outside of the fenced area and
interview with neighboring property owners/operators only), and review of the EDR data
base, It is unlikely that the subject property has been materially impacted by the
surrounding recognized environmental conditions as described in the foregoing
sections. The following conclusions and recommendations are, however, provided by
TRE regarding the subject site:
It is unclear what information could have been derived and used in TRE's
Page 2 of 27
