SU-91-14 OF BOGETTI BROTHERS (C/O NOLTE & ASSOCIATES) <br /> ---------------------------------------------------------------- <br /> The Development Committee will review this pre-application on March <br /> 27 , 1991. <br /> This pre-application is to cancel the Williamson Contract, to <br /> change the zoning from AG-40 to RA-30 and to subdivide 15 . 9 acres <br /> into 20 lots. <br /> The General Plan 1995 Map for Vernalis shows a strip approximately <br /> 250 feet wide, on the east side of Welty Road, south of State Route <br /> 132 as Residential Low Density. This would be around 10 acres of <br /> a 134 acre parcel. The rest of the parcel is designated Agriculture <br /> on the General Plan. Although application for rezoning and <br /> development can be accepted, the staff recommendation will be <br /> based on factors such as the surrounding area, the specific <br /> development proposal, and potential impacts. In this case the <br /> zoning for the entire parcel and the one to the east is AG-40 . The <br /> proposal would be a substantial extension of development to the <br /> east of Welty Road. Staff therefore would recommend that <br /> development not be extended further into an agricultural area. <br /> The proposed General Plan 2010 designates this entire parcel <br /> General Agricultural. <br /> The whole parcel is under Williamson Contract. This is further <br /> evidence of commitment of the area to agriculture rather than <br /> residential. If a Notice of Non-Renewal were issued, it would take <br /> 10 years for the contract to lapse. When that ten years had <br /> elapsed, the proposed General Plan would be in effect and would <br /> prohibit the rezoning. The applicant is proposing a Contract <br /> Cancellation application to hasten the process and allow processing <br /> under the present General Plan. <br />
