Analysis <br /> Background <br /> On January 27, 1983, the County issued a business license for "Ag. Related Machine <br /> Shop Work" at this site. On April 6, 1987, the Community Development Department <br /> approved a Home Occupation permit for a machine and welding shop. As an ordinance <br /> requirement, the use was limited to 250 square feet with no outdoor storage. At that <br /> time Lhc site -was zoned GA-10 (General Agriculture). The Home Occupation <br /> supercedes the previous business license. On November 3, 1987, the General Plan <br /> designation was changed to R/R, and the zone was changed to RR-65. <br /> The adoption of the 2010 General Plan in 1992 continued the R/R General Plan <br /> designation and changed the zone to R-R (Rural Residential). The Community <br /> Development Department cited the owner in 1997 for adding on to the welding shop <br /> without the required permits. The Community Development opened an Enforcement <br /> File in 1998. The business license for the Home Occupation/welding shop expired on <br /> April 20, 1999. <br /> The site is located in unincorporated San Joaquin County in the urban community of <br /> Tracy. Surrounding land uses to the west and southwest consist primarily of industrial <br /> uses, including a produce packing and transport yard. The transport yard utilizes the <br /> parcel immediately west of the site as a truck turning and holding area for produce trucks <br /> loading at the yard across Linne Road. However,that site is zoned R-R, and the transport <br /> yard is operating without permits and is not permitted in the R-R zone. Surrounding uses <br /> to the east and south consist exclusively of rural single-family residential and agricultural <br /> uses. <br /> The subject parcel is owned by Mr. Kjensrud, who operates an agricultural welding <br /> business known as Tracy Welding and Supply. The parcel contains a warehouse used for <br /> the business and a single-family residence. Both uses are within a single fenced-in <br /> property. <br /> During discussions between the Community Development Department and each <br /> individual Supervisor regarding Planning and General Plan issues Countywide, Supervisor <br /> Robert Cabral requested that the Community Development Department initiate this <br /> General Plan Amendment and Zone Reclassification. <br /> General Plan and Zoning <br /> In the R-R zone, the owner may apply for a Site Approval application to establish a <br /> Home.Occupation for up to 400 square feet of area. However, the owner was cited for <br /> 1200 square feet of additions. If approved, the I-W zone will allow the owner to apply <br /> for a Use Permit application to establish a welding shop (use type: General Industrial, <br /> Intermediate) and bring the facility into compliance. <br /> San Joaquin County <br /> Community Development -10- GP-98-6, ZR-00-6\Kjensrud <br />
