DC-92-3 OF RANCHETTES <br /> UNLIMITED (C/O CHARLES PRINGLE) <br /> ----------------------------------------------------------------- <br /> The applicant is proposing an eight unit dwelling cluster on an <br /> 80 acre parcel. <br /> The Development Services Division has reviewed this item and <br /> offers the following comments: <br /> This application is ministerial and ordinarily, is exempt from <br /> CEQA. However, this project includes the requirement for a <br /> Private Right-of-way for a lot of an antiquated subdivision. The <br /> right-of-way is discretionary and is subject to CEQA. Section <br /> 15268 (d) of the CEQA Guidelines states: <br /> Where a project involves an approval that contains elements <br /> of both a ministerial action and a discretionary action, the <br /> project will be deemed to be discretionary and will be <br /> subject to the requirements of CEQA. <br /> An Initial Study was prepared on July 8, 1992 . On the basis of <br /> that study, a Negative Declaration was prepared. The Initial <br /> Study shall be prepared 30 days prior to taking action on this <br /> item, therefore, this application will not be approved prior to <br /> August 7, 1992 . <br /> As a ministerial application, this item is subject to all of the <br /> requirements of Section 9-2284 (attached) . The following <br /> requirements apply to this item. However, as this project is <br /> revised to meet the ordinance requirements, other ordinance <br /> requirements may also apply: <br /> Unless otherwise specified, all Conditions of Approval must be <br /> fulfilled prior to the establishment of the use and the issuance <br /> of any building permits. <br />
