DC-92-3 OF RANCHETTES UNLIMITED (C/O CHARLES PRINGLE) ----------------------------------------------------------------- The applicant is proposing an eight unit dwelling cluster on an 80 acre parcel. The Development Services Division has reviewed this item and offers the following comments: This application is ministerial and ordinarily, is exempt from CEQA. However, this project includes the requirement for a Private Right-of-way for a lot of an antiquated subdivision. The right-of-way is discretionary and is subject to CEQA. Section 15268 (d) of the CEQA Guidelines states: Where a project involves an approval that contains elements of both a ministerial action and a discretionary action, the project will be deemed to be discretionary and will be subject to the requirements of CEQA. An Initial Study was prepared on July 8, 1992 . On the basis of that study, a Negative Declaration was prepared. The Initial Study shall be prepared 30 days prior to taking action on this item, therefore, this application will not be approved prior to August 7, 1992 . As a ministerial application, this item is subject to all of the requirements of Section 9-2284 (attached) . The following requirements apply to this item. However, as this project is revised to meet the ordinance requirements, other ordinance requirements may also apply: Unless otherwise specified, all Conditions of Approval must be fulfilled prior to the establishment of the use and the issuance of any building permits.
