' On 24 September 1997,Amherst Inc.completed apreliminary site assessment(18 September <br /> • 1997 visual inspection) for diesel contamination of soil under one of the pump islands. <br /> Amherst proposed to develop a work plan to determine the extent of the contamination. <br /> ' Work was later performed to assess soil. for contaminates released from the dispenser. <br /> • On 28 October 1997,an EHD UST Unauthorized Release(Leak)/Contaminated Site report <br /> ' changed the case type from a soil-only release to undetermined and the EHD issued a letter <br /> to Connell Motor Trucking requiring further assessment of soil and groundwater <br /> ' contamination. <br /> • In February 1998, an EHD site inspection discovered that the vapor recovery system was <br /> inoperable and shut down the gasoline dispensing system pending repair of the system. <br /> ' On 9 March 1998, Connell Motor Truck terminated their lease with River City Petroleum <br /> citing economic hardship with regard to the required repairs.The UST system did not operate <br /> ' after that time. <br /> • On 20 March 1998, a routine EHD inspection found that the dispensers had been removed, <br /> the concrete islands had been broken, and tanks 5,6 and 7 had been improperly abandoned; <br /> in addition,the site was in violation of the 10/11 September abatement order.A hearing was <br /> scheduled for after 30 April 1998. <br /> • On 7 April 1998,Amherst Inc.issued a site status memo on the spill assessment;this memo <br /> referenced an 11 November 1997 work:plan for a site assessment that was not in the files <br /> reviewed and an 05 December 1997 verbal approval of the work plan. According to the <br /> lie memo,severe weather had postponed assessment until 13 March 1998;on that date Amherst <br /> collected two shallow soil samples under the concrete apron, one at the surface and one at <br /> a depth of 1.5 feet. Laboratory analysis detected elevated levels of diesel and what appeared <br /> ' to be weathered gasoline;these levels were substantially reduced(90%)within the first foot <br /> of depth.Amherst concluded that limited subsurface contamination posed little threat to the <br /> environment, and that additional work would not required for site closure by the owner <br /> ' (Connell Motor Truck). <br /> • On 11 June 1998,UST Numbers 5,6 and 7 were removed.Thorpe Oil of Lodi excavated and <br /> removed the fueling facility as well as piping discovered during removal of the former UST <br /> system in 1986. The soil under the three USTs was analyzed and reported as non-detect for <br /> all analytes; however, hydrocarbon-impacted soil was found beneath the dispenser and the <br /> ' old piping.Subsequently,a limited volume of impacted soil was removed and the excavation <br /> was backfilled with pea gravel. <br /> ' On 29 July 1998,Connell Motor Truck and River City Petroleum received an official Notice <br /> ofResponsibility letter from EHD informing them that the site has been assigned to the Local <br /> Oversight Program for assessment and remediation. <br /> • On 09 October 1998,an EHD memo noted receipt of an incomplete work plan for site over- <br /> excavation,submitted by Foothill Engineering(FE).An expanded work plan and Executive <br /> ' Summary for public review were needed. <br /> • On 20 October 1998, a revised work plan was submitted by FE that proposed excavation of <br /> • all contaminated soil from the dispenser and piping area.
