n. A performance guarantee, payable to San Joaquin County and the State Geologist, shall <br /> be required to ensure rehabilitation of the site and compliance with Conditions of Approval. <br /> The estimated cost of rehabilitation shall be reviewed by the Department of Public Works. <br /> The type of guarantee proposed by the applicant must be found acceptable by the County <br /> Counsel. The type of financial guarantee may be, but is not limited to, the following: <br /> (1). A Surety Bond. <br /> (2). A Trust Fund. <br /> (3). An Irrevocable Letter of Credit. <br /> o. Dikes shall be constructed around areas under excavation outside of the expansion pit. Water <br /> shall be directed by pipe or ditch to and fro the settling ponds. Construction of dikes shall be <br /> subject to approval by the Department of Public works and the State Water Quality Control <br /> Board and shall be designed to prevent erosion, siltation, and water runoff from the site. <br /> p. A clearance permit shall be required from the Army Corps of Engineers prior to discharging fill <br /> material into drainages, wetlands, or vernal pools. <br /> q. Reclamation for the project shall be in accordance with the approved Reclamation Plan. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> Ordinance Requirements: <br /> The Ordinance Requirements listed below have been identified as pertinent to this project. Other <br /> Ordinance Requirements may also apply. Ordinance Requirements cannot be modified. <br /> a. The excavation plan shall be prepared by a Registered Civil Engineer and shall include the <br /> following: <br /> (1). Detail of the access road (the first 100 feet from Waverly Road shall be paved). <br /> (2). A plan of the haul route for County Roads. <br /> (3). Final grading plan and drainage provision. <br /> (4). Excavation boundaries and quantities of excavation and direction of excavation. <br /> (5). Stockpile area for topsoil. (No excavation or stockpile shall be allowed within 25 <br /> feet of the property boundary or the County right-of-way.) <br /> b. Loads to the Waverly Road shall be restricted to the legal limit. <br /> C. An encroachment permit shall be required for work within the road right-of-way. <br /> d. Public Roads shall be kept free from mud, dirt and gravel resulting from quarry operations. <br /> All on-site haul roads shall be maintained so as to control the dust. <br /> e. A video tape of road conditions on Waverly Road from Shelton to Flood Road is required <br /> prior to the start of excavation. The condition of Waverly Road shall be reviewed with the <br /> Department of Public Works prior to the start of excavation and every five years thereafter. <br /> If it is determined necessary by the Department of Public Works during the excavation, the <br /> applicant shall construct an acceleration land and/ or a left-turn lane on Waverly Road to <br /> permit safe egress and ingress from the site. Road construction and design shall be <br /> subject to approval by the Department of Public Works.
