Analysis <br /> Background <br /> On April 27, 1993, the Board of Supervisors approved Zone Reclassification No. ZR-93-1 to reclassify 19 <br /> acres from AU-20 to I-L to enable the applicant to establish an open-air mall. The Board of Supervisors <br /> approved the Zone Reclassification subject to the following conditions: <br /> 1. Until all public facilities are available (water, sewage disposal, and storm drainage), the property can <br /> only be used for an open-air mall. <br /> 2. Prior to establishing an open-air mall on the site, a Use Permit for the use must be approved by the <br /> Board of Supervisors. <br /> On June 23, 1993, the Board of Supervisors approved Use Permit No. UP-93-9 to permit the operation of an <br /> open-air mall on the property. The approval permitted an open-air mall for 400 vendors to operate four days <br /> per week between the hours of 7:00 a.m. and 10:00 p.m. <br /> On December 21, 2000, the Planning Commission approved Site Approval No. SA-00-56 to conditionally <br /> permit the construction of twenty-four (24) storage/retail buildings totaling 82,100 square feet and one <br /> caretaker mobile home. A proposed truck driving school with storage area for four trailers was not <br /> permitted. The conditional approval expired on July 2, 2002. However, with the filing of the Time Extension <br /> application, the conditional approval is extended for up to an additional 60 days (Development Title Section <br /> 9-881.4). <br /> The Open Air Mall has also been under enforcement In July 2000, the Community Development Department <br /> cited the manager for violations of the Uniform Fire Code and Uniform Building Code. <br /> The Fire Code violations consisted of not having the proper permits for the following: <br /> • Places of assembly <br /> • Temporary tents <br /> • A carnival and/or fair <br /> Building Code and County Ordinance Code violations consisted of the following: <br /> • Operation of a business without a business license <br /> • Building a grandstand without permits <br /> • Building a performing stage without permits <br /> • Having a commercial coach without permits <br /> The Building Code and County Code violations, and the Fire Code violation regarding places of assembly, have <br /> been resolved and are no longer enforcement issues. The violations regarding the temporary tents and carnival <br /> have not been resolved to the satisfaction of the Community Development Department and are referenced in this <br /> staff report as Building and Fire Code violations.
