Recommendations
Action
It is recommended that the Planning Commission deny the request for a one-year Time Extension based on
the inability to make Finding No.4.
Findings
1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan,
any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan
adopted by the County.
• This finding can be made because the establishment, maintenance, and operation of the
use do not conflict with the General Plan, and the use proposed in Site Approval No. SA-
00-56 is consistent with the special zoning approved for the project.
2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary
facilities have been provided, and the proposed improvements are properly related to existing and
proposed roadways.
• This finding can be made because adequate utilities, access roads, sanitation, drainage
and other necessary facilities have been provided, and the proposed improvements are
properly related to existing and proposed streets and highways because all utilities,
improvements, and other facilities are existing or will be provided as reflected in the
approved site and/or improvement plan(s).
3. The site is physically suitable for the type of development and for the intensity of development.
• This finding can be made because the property involved is of adequate size and shape to
accommodate the proposed use and all yards, building coverage, setbacks, parking areas
and other requirements of this Title, and the property is adequate in size to accommodate
provisions of the Development Title.
4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be
injurious to the property or improvements of adjacent properties.
• This finding cannot be made because the project site has excessive amounts of junk and
trash on the site as well as on-going unpermitted uses occurring at the site such as the
carnival and truck driving school. Additionally, there are Building and Fire Code violations
at the site.
5. The use is compatible with adjoining land uses.
• This finding can be made because with the Conditions of Approval the proposed use will
not interfere with or alter the current uses on adjacent properties.
Previously Approved Conditions
See the attached Conditions of Approval.
San Joaquin County SA-00-56\Stockton Open Air Mall
Community Development Page 5
