On April 11, 1996, a "Notice of Code Violation, " was recorded against the property. 10 .On October 21, 1996, Jerry Herzick stopped a truck from dumping concrete with rebar, wire mesh, wood, and plastic pipe . A second "Stop Work Order, " was issued and posted on site . ll .On November 27, 1996, I forwarded a memo to Lisa Brown of you office and requested assistance in prosecuting this case . No case was ever filed. 12 .On March 20 , 1997, Jerry Herzick met with Dennis Rippey at the site . Mr. Rippey agreed to obtain a grading permit and would call for inspections prior to doing any back filling of the rock hauled to the site . He was also ordered to apply for a Site Approval Application to permit the operation of stockpiling of compost material on the site . To date this application has not been filed. 13 .On September 11, 1997, I inspected this site with Mike Huggins and yourself for violations and found the property to contain a large amount of concrete debris of the wrong size and containing rebar in the holding pond. I also observed numerous very large piles of compost material stored on the site with no Site Approval Application filed. 14 .On September 12 , 1997, I again looked at this site with Mike Huggins and Ed Padilla from the County Environmental Health Department regarding violations on this property. The current violations on this property are : 1 . Section 9-1905 . 3 Countv Ordinance Code to wit : Permitting or maintaining a public Nuisance by Operation of a Landfill not permitted without a permit . 2 . Section 9-1905 . 3 County Ordinance Code to wit : Permitting or maintaining a public Nuisance by storage and or recycling of trash, junk, asphalt, concrete and compost not permitted without a permit .
