WE ORNIA—HEALTH AND WELFARE AGENCY GEORGE DEUKMEJIAN, Governor
Pr DEPARTMENT OF HEALTH SERVICES
TOXIC SUBSTANCES CONTROL PROGRAM
REGION I
FRESNO DISTRICT OFFICE
5545 EAST SHIELDS AVENUE
FRESNO,CA 93727
October 5, 1990
L41
OCT 9 110"0
Ms. Kasey Foley ENVIRONMENTAL HEALTH
Public Health Services PERM IT/SERV1 CES
P.O. Box 2009
Stockton, CA 95201
Dear Ms. Foley:
I received a copy of your Memo of Call to Beth Ambacher dated
August 28, 1990. Your concern was that British Petroleum (BP)
has shipped to Gibson Oil and Refining (GOR) three loads of a
gasoline, diesel fuel, and water mixture for used oil pursuant
to Section 25250. 8 of the Health and Safety Code (H&SC) .
I checked with GOR, Bakersfield, California during my enhanced
surveillance inspection on September 10-14, 1990. They
informed me that this waste was sent to their facility located
in Redwood City, California. They further stated that the
waste shipped was exempt by Section 25250. 3, H&SC.
Based on the exemption pursuant to Section 25250. 3 , H&SC the
waste did not meet the definition of used oil as found in
Section 25250. 1, H&SC. Therefore, BP' s use of the modified
manifest system (25250.8 , H&SC) was not appropriate. B. P.
would be in violation of transporting a hazardous waste without
using a Hazardous Waste Manifest, again assuming that the waste
was a hazardous waste.
If I can be of any further assistance or you want the name of
the people I talked to, please contact me at (209) 445-6165.
sincerely,
d l-
David L. Shumate
Hazardous Materials Specialist
cc: Ms. Beth Ambacher, Hazardous Materials Specialist
