September 8, 2003 Conoco Phillips Company Shari London 3611 Harbor Blvd S,#200 Santa Ana, CA 92704 UNDERGROUND STORAGE TANK CLEANUP FUND(FUND),REQUEST FOR FURTHER DOCUMENTATION DURING INITIAL REVIEW: CLAIM NUMBER 017765;FOR SITE ADDRESS: 3505 NAVY DR, STOCKTON After reviewing your claim application to the Cleanup Fund,we find that the following additional information is needed to determine your eligibility for placement on the Priority List: • Page two of your claim application was incomplete. For better clarification,please complete this page for the release and USTs for which you(Conoco Phillips Company) seek reimbursement costs on. You submitted an attachment to page two(2)where you have listed a number of tanks, some of which are ineligible for Fund participation because you never owned or operated them and/or they do not meet the definition of a UST(i.e., above ground tanks are ineligible). • Page three of you claim application needs clarification on the UST Operators. 1)You list Mobil as the UST Owner from 1938 through 1989(and UST Operator as of Dec. 1994"?);however,you have submitted operating permits issued to Mobil through 1990. 2)You have listed BP as the UST owner/operator from 1989 through 1994;however,you have submitted operating permits issued to BP from 1991 through 1999. 3)You have listed S.T. Services as the operator from 1998 through the present;however you have submitted operating permits issued to S.T. Services from 2000 through the present. Please clarify or make appropriate revisions to page three. Also,please be specific on the dates(dd/mm/yy)under Time Period. • Page four(4)of your claim application you indicated that you have sought, or intend to seek,money from BP as another party potentially responsible for the unauthorized release. Please keep the Fund informed with any updates on this matter. • Page five of your claim application was incomplete. Please compete the highlighted section for the UST Operator at Time of Application Submittal (or clarify). • Page seven(7) of your claim application was a copy and isn't signed by the same person(Mike Bryan or Sterling Hundley) as indicated on the Power of Attorney form(dated 7/16/03)that Conoco Phillips Company submitted as a global change for multiple claims to the Fund. The Claimant must provide an "original signed"Verification and Signature Page including signatory's title as related to the claimant(see enclosed Verification and Signature page). • The map you submitted includes several USTs and ASTs.
