Defendants, and each of them, violated the <br /> 2 provisions of the Fire Code; said acts include but <br /> 3 are not limited to the following violations of said <br /> 4 provisions: <br /> 5 1 ) Violations of §79 .111 in defendants <br /> 6 discharged flammable liquids or any waste liquid <br /> 7 containing petroleum upon the ground in that defen- <br /> 8 dants pump oil and water waste that spills at their <br /> 9 facility onto the ground of adjacent proper'- T (the <br /> 10 unlined pond/ lagoon ) . <br /> 11 2 ) Violation of §79 .508 (e) in that defen- <br /> 12 dants failed to keep a diked area free of com- <br /> 13 bustible material in that petroleum product is <br /> 14 allowed to stand in unpermitted containers in the <br /> 15 diked area . <br /> 16 <br /> 17 30 . Thus, the defendants have in the course of their opera- <br /> 18 tion and management of their business engaged in unlawful con- <br /> 19 duct . This unlawful conduct of the defendants constitutes unfair <br /> 20 competition within the meaning of Business and Professions Code <br /> 21 Section 17200 and is conduct which is an unlawful, unfair, and <br /> 22 fraudulent business practice. <br /> 23 FIFTH CAUSE OF ACTION <br /> 24 <br /> (NUISANCE) <br /> 25 31 . Plaintiff realleges and incorporates by reference as <br /> 26 though set forth in full herein <br /> g paragraphs 1 through 30 , <br /> 27 inclusive . <br /> 28 <br /> 15. <br />
