1 described in paragraphs 3 or 4 above. Any penalties or other relief sought by Plaintiff for such <br /> 2 violations or alleged violations shall be sought by noticed motion. Plaintiff shall notify Defendant in <br /> 3 writing of such alleged violations and shall meet and confer with Defendant within twenty (20) <br /> 4 business days of such written notice prior to filing any such motion. The Parties shall negotiate in <br /> 5 good faith in an effort to resolve any further penalty assessments or other relief pursuant to this <br /> 6 paragraph without judicial intervention. Defendants reserve all defenses in law and equity. <br /> 7 7. If all the conditions listed in paragraph 5 above are met,then THREE(3)years from the <br /> 8 filing date of this document, the stayed penalty shall be suspended permanently. <br /> 9 8. Defendant shall additionally pay to Plaintiff the sum of FIVE HUNDRED DOLLARS <br /> 10 ($500.00) as partial recovery of the cost of investigation and suit incurred by the SAN JOAQUIN <br /> 11 COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said payment shall be due and]awe <br /> 12 to the aforementioned agency, and shall be delivered to the San Joaquin County Office of the District <br /> 13 Attorney, Environmental Prosecutions Unit, at time of signing. <br /> 14 9. Defendant shall additionally pay to Plaintiff the sum of ONE THOUSAND SEVEN <br /> 15 HUNDRED DOLLARS ($1,700.00) as partial recovery of the cost of investigation and suit incurred <br /> 16 by the San Joaquin County Office of the District Attorney. Said payment shall be due and payable to <br /> 17 the aforementioned agency, and shall be delivered to the San Joaquin County Office of the District <br /> 18 Attorney, Environmental Prosecutions Unit, at time of signing. <br /> 19 10. Defendant shall fund Environmental Training Programs in the amount of THIRTEEN <br /> 20 THOUSAND THREE HUNDRED DOLLARS ($13,300.00), as special projects, commonly known <br /> 21 as Supplemental Environmental Projects, as described below. The payment shall be due and pa ya�ble. <br /> 22 to the below mentioned agencies,and shall be delivered to the San Joaquin County Office of the <br /> 23 District Attorney, Environmental Prosecutions Unit, at time of signing. The THIRTEEN <br /> 24 THOUSAND THREE HUNDRED DOLLARS ($13,300.00)will be allocated as follows: <br /> 25 a. SIX THOUSAND SIX HUNDRED AND FIFTY DOLLARS ($6,650.00)payable <br /> 26 to the CUPA FORUM ENVIRONMENTAL PROTECTION TRUST FUND to be used for the <br /> 27 purpose of ei-diancing the investigation, inspection and enforcement of Unified Programs throughout <br /> 28 the State of California; <br /> -3- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
