SIX THOUSAND SIX HUNDRED AND FIFTY DOLLARS ($6,650.00)payable <br /> 2 to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT— <br /> 3 ENVIRONMENTAL HEALTH DIVISION TRUST to be used by the San Joaquin County <br /> 4 Environmental Health Department, at its discretion,to fund compliance training local businesses. <br /> 5 11. At any time after the Final Judgment has been in effect for FIVE (5) years, and <br /> 6 Defendant has paid all amounts due hereunder, Defendant may, with notice to Plaintiff, file a motion <br /> 7 requesting that the Court order that the Permanent Injunction provisions of Paragraphs 3 and 4 shall <br /> 8 have no prospective force or effect based on Defendant's demonstrated history of compliance with <br /> 9 the Final Judgment. Within thirty (30) days of the filing of Defendant's motion,the People will <br /> 10 either: take no action, file a statement of non-opposition, or file an opposition. If the People agree <br /> 11 that Defendant has substantially complied with the obligations set forth in the Final Judgment,the <br /> 12 People will file a statement of non-opposition to Defendant's motion. Otherwise, the People may file <br /> 13 an opposition setting forth the People's reasoning and will recommend that the Final Judgment, <br /> 14 including the injunctive provisions, remain in effect. Within fifteen(15) days of any filing by the <br /> 15 People, Defendant may file a reply. The Parties agree that the Court may grant Defendant's request <br /> 16 upon determining that Defendant has substantially complied with the obligations set forth herein. <br /> 17 12. Defendant is responsible for the uniform fee for filing the first paper in a civil action or <br /> 18 proceeding in the Superior Court. The amount of the filing fee is THREE HUNDRED NINETY- <br /> 19 FIVE DOLLARS ($395.00). Said payment shall be made payable to the SAN JOAQUIN COUNTY <br /> 20 SUPERIOR COURT and delivered to the San Joaquin County Office of the District Attorney, <br /> 21 Enviromnental Prosecutions Unit, at time of signing. <br /> 22 13.
