.ti
Negative Declaration,Stockton Soils Treatment Facility -2- 16 August 1991
Page 20, Detailed Environmental Assessment, item 1,Mitigation Measure c.—Change
"Waste Management Unit" to "waste pile" per the comment above for page 19. In
addition, the referenced regulations are now cited as "Title 23, Division 3, Chapter 15"
instead of "Title 23, Chapter 3, Subchapter 15".
Page 21,Detailed Environmental Assessment, item 2, Settin& 912 —The contaminated
soil is classified as a 'designated waste under Title 23, Division 3, Chapter 15 of the
California Code of Regulations, not under the Health and Safety Code. The definition of
'designated waste' in§2522 (a) includes nonhazardous waste which contains pollutants
that could pose a threat to water quality. The last sentence of this paragraph incorrectly
indicates that designated waste constituents "do not pose a threat to water quality". In
addition, the 'designated waste' definition includes hazardous wastes which have been
granted a variance from the Title 22 CCR hazardous waste management requirements by
the State Department of Toxic Substances Control (formerly Department of Health
Services,Toxic Substances Control Program).
Page 21, Detailed Environmental Assessment, item 2,Mitigation Measure b.—As
discussed above, Class II waste containment systems, including berms, must be designed
to accommodate the 1000-year, 24-hour storm condition.
If you have questions regarding these comments, please call me at (916) 361-5724.
Jon Marshack, D. Env.
Senior Environmental Specialist
Environmental/Technical Support Unit
Land Discharge Section
.m
cc: Mr. Leon Brasowski, Ogden Environmental Services, Inc., San Diego
Martha Vasquez, California Integrated Waste Management Board
Ed Padilla, San Joaquin County Environmental Health Services
