Box 2009 <br /> Stockton, CA 95201 <br /> OGDEN ENVIRONMENTAL SERVICES, INC., STOCKTON SOILS TREATMENT <br /> FACILITY—PROPOSED MITIGATED NEGATIVE DECLARATION <br /> Regional Board staff is preparing a set of waste discharge requirements to implement our <br /> Discharges of Waste to Land regulations (California Code of Regulations [CCR], Division 3, <br /> Chapter 15, hereafter Chapter 15) for Ogden's Stockton Soils Treatment Facility. As part <br /> of this effort, I have reviewed the subject document. The following are my comments: <br /> Page 12,Initial Study, item 6.15.—The potential for ground water degradation noted by <br /> the asterisk under item Lb. indicates that the project has the potential to affect the <br /> potential use of a natural resource,namely ground water. Under the Water Quality <br /> Control Plan (Basin Plan)for the Sacramento River, Sacramento-San Joaquin Delta, and San <br /> Joaquin River Basins (5A,5B,and 5C), ground water beneath the facility has the existing <br /> and potential beneficial uses of municipal, domestic, agricultural, and industrial supply. <br /> Therefore, an asterisk should be included next to the 'NO" response to item 6.b. The <br /> mitigations listed for item Lb. would apply here, as well. <br /> Page 19, Detailed Environmental Assessment, item 1,Analysis—Since different types of <br /> Class II waste management units (landfills, surface impoundments, waste piles and land <br /> treatment units) are required to provide different containment systems to prevent waste <br /> migration into surrounding natural geologic materials and waters of the State, the specific <br /> type of waste management unit should be specified in the last sentence of the first <br /> paragraph. The end of this sentence should read "... for Class II waste piles" <br /> Page 20, Detailed Environmental Assessment, item 1,Mitigation Measure a. —The <br /> contaminated soils stockpile is required to meet Class II waste pile specifications of our <br /> Chapter 15 regulations. §2546(a) and (b) of Chapter 15 require Class II waste piles and <br /> associated containment structures (including berms) to be designed and constructed to <br /> prevent ponding, infiltration, inundation, erosion, slope failure, washout, and <br /> overtopping under 1000-year, 24-hour storm conditions,rather than the 100-year storm <br /> conditions cited in this mitigation. <br />
