Golden State Blvd <br /> Fresno, CA 93722 <br /> WATER CODE SECTION 13260 REQUEST FOR COMPLETE REPORT OF WASTE DISCHARGE, <br /> GENERAL WASTE DISCHARGE REQUIREMENTS FOR COMPOSTING OPERATIONS, HARVEST- <br /> LATHROP COMPOSTING FACILITY, SAN JOAQUIN COUNTY <br /> On 4 August 2015, the State Water Resources Control Board (State Water Board) adopted General <br /> Waste Discharge Requirements for Composting Operations, Order WQ 2015-0121-DWQ (General <br /> Order). Existing composting operations that were not already regulated by Board-issued waste <br /> discharge requirements (WDRs) or by a conditional waiver were required to seek coverage under the <br /> General Order by submitting a Notice of Intent (NOI), a technical report, and a filing fee to the <br /> appropriate Regional Water Board. The NOI, technical report, and filing fee were due within one year <br /> of the adoption of the General Order (by 4 August 2016). <br /> On 13 January 2016, and again on 13 May 2016, Central Valley Water Board staff sent you <br /> informational letters notifying you of the requirement to submit a complete NOI, technical report, and <br /> filling fee by 4 August 2016. On 3 August 2016, Harvest Power submitted a NOI, a draft technical <br /> report, and the appropriate filing fee, and requested a time extension to the General Order submission <br /> deadline in order to finalize their technical report. Water Board staff acknowledges your extension <br /> request. Staff requests that Harvest Power submits a complete report of waste discharge (ROWD) to <br /> this office by 4 November 2016. <br /> Water Code section 13260 requires that "any person discharging waste, or proposing to discharge <br /> waste, that could affect the quality of waters of the state" must file "a report of the discharge containing <br /> the information that may be required by the regional board." Under the terms of the General Order, the <br /> NOI, technical report, and filing fee are together considered a ROWD, and submitting this package <br /> satisfies the requirements of Water Code section 13260. <br /> Water Code section 13261 states, in relevant part: <br /> (a) A person who fails to furnish a report or pay a fee under Section 13260 when so <br /> requested by a regional board is guilty of a misdemeanor and may be liable civilly in <br /> accordance with subdivision (b). <br /> (b) (1) Civil liability may be administratively imposed by a regional board or the state board <br /> in accordance with Article 2.5 (commencing with Section 13323) of Chapter 5 for a <br /> KARL E.
