Performing composting operations without regulatory coverage is a violation of the Water Code. Pursuant to Water Code section 13260, your complete Report of Waste Discharge must comply with the requirements of the adopted General Order. Under Water Code section 13261, Harvest Power may be liable for up to $1,000 per day in administrative civil liabilities for every day it is in violation of this requirement, and this period of non-compliance may be retroactive back to 4 August 2016, Request for a Complete Report of Waste Discharge The three components of the Composting General Order Report of Waste Discharge includes: (1) the Notice of Intent application, (2) the technical report, and (3) the filing fee. 1. The Notice of Intent is available as Attachment C of the General Order on the State Water Board web page at: http://ww*w.waterboards.ca,gov/board decisions/adopted orders/water guality/2015/wqo2015 012 1 dwq.pd 2. The second component of the ROWD is the technical report which includes information necessary for the Central Valley Water Board to evaluate the waste discharges that are related to your composting operations. The third component is the filling fee, The Water Code requires any person discharging waste, or proposing to discharge waste, within any region that could affect the quality of the waters of the state to submit an annual fee (Wat. Code, § 13260, subd. (d)(1)(A)). The appropriate filling fee for composting sites is based on Tiers identified in the General Order. For Tier I facilities, the filling fee and first year permit fee is $2,088, For Tier 11 facilities, the filing fee and first year permit fee is $4,699. Once the ROWD information is received and deemed to meet the requirements of the General Order, staff will recommend that the Executive Officer issue a Notice of Applicability (NOA) enrolling Harvest Power under the General Order.
