1 5 . Jurisdiction over this matter exists pursuant to HSC § 25404 . 1 . 1 . <br /> 2 6 . Respondents waive any right to a hearing in this matter. <br /> 3 7 . This Consent Order shall constitute full settlement of all violations of Chapter 6 . 5 <br /> 4 and 6 . 67 of the California Health and Safety Code pertaining to the Site and arising before <br /> 5 the Effective Date of this Consent Order , This Consent Order does not limit the CUPA from <br /> 6 taking appropriate enforcement action concerning any other violations . <br /> 7 8 . Respondents admit the violations described above . <br /> 8 SCHEDULE FOR COMPLIANCE <br /> 9 9 . The violations have been corrected . <br /> 10 PAYMENTS <br /> 11 10 . Respondent shall pay the CUPA a total of $ 4 , 520 . 00 of which $ 3 , 000 is a penalty <br /> 12 and $ 1 , 520 . 00 is reimbursement of the CUPA's costs , through the effective date . <br /> 13 Respondent shall make an initial payment of $ 1520. 00 within 30 days of the effective <br /> 14 date of this consent order . Subsequent payments of $ 1000 . 00 shall be due March 30 , <br /> 15 2020 , April 27 , 2020 and May 26 , 2020 for a total of $ 4 , 520 . 00 . All additional CUPA costs <br /> 16 will be billed at the current hourly rate . Respondent' s checks shall be made payable to <br /> 17 " San Joaquin County Environmental Health Department , " and shall be delivered together <br /> 18 with the attached Payment Voucher to : <br /> 19 San Joaquin County Environmental Health Department <br /> 20 Certified Unified Program Agency CUPA <br /> 21 1868 E . Hazelton Ave <br /> 22 Stockton CA 95205 <br /> 23 A photocopy of the check shall be sent to the following CUPA personnel assigned to <br /> 24 this matter , Michelle Henry , San Joaquin County Environmental Health Department , If <br /> 25 Respondent fails to make payments as provided above , Respondent agrees to pay interest <br /> 26 at the rate established pursuant to HSC § 25360 . 1 and to pay all costs incurred by the <br /> 27 CUPA in pursuing collection including attorney ' s fees . <br /> 28 OTHER PROVISIONS <br /> 2 <br /> CONSENT ORDER UNITED PIPE AND STEEL CORP . <br />
