In the 15 June 2004 <br /> response, staff stated that, the settled <br /> solids, which rest on top of the liner, are a <br /> threat to water quality. This requirement <br /> for immediate source removal is inline <br /> with the guidelines for clean up actions in <br /> SWRCB Resolution 92-49 and Section <br /> 20430(c)of Title 27. <br /> Task Install a staff gauge Change Made: The compliance date was <br /> 2Cii in each impoundment... changed to 15 October 2004. Considering <br /> the Dischargers inability to successfully <br /> close the ponds, staff feels it is necessary <br /> to have a means of monitoring <br /> compliance. The USGS reports the <br /> annual average rainfall for the area around <br /> the SMS Briners facility is between 12 <br /> and 14 inches. Staff is allowing half of <br /> the annual precipitation to remain in the <br /> pond at any time. If the discharger would <br /> prefer to remove the impoundment(s) <br /> walls prior to 15 October 2004, this <br /> requirement could be withdrawn. <br /> A public hearing and consideration of these proposed WDRs by the Regional Board is scheduled for 9 <br /> July 2004 in Sacramento.
