The letter you submitted from San Joaquin County dated May 29, 2003 <br /> identifies YLY LLC (the property owner) as the responsible party. Claimant is advised that an eligible <br /> claimant must have either owned or operated the subject leaking UST, is the responsible party directed to <br /> undertake corrective action for the unauthorized releasees the local regulator and is the party paying for <br /> the costs of cleanup. Please clarify and advise. <br /> • Provide a copy of the first letter from the local regulatory agency naming you (7-Eleven, Inc.) a <br /> responsible party and directing you to cleanup the contamination at the subject site. <br /> • Claimants who acquire sites after January 1, 1990,must complete the enclosed Claimant Certification <br /> of Compliance with Fund Regulations Section 2811(a)(1)-(2) and Health& Safety Code, Section <br /> 25299.54, subdivision (h). <br /> AND <br /> • A copy of the permit to own or operate the UST from the local implementing agency dated between <br /> January 1, 1984 and January 1, 1990 (pursuant to Chapter 6.7 of the Health and Safety Code). <br /> • Claimant is required to provide documentation that all current and prior UST fees due on or after <br /> January 1, 1991 imposed by Section 25299.41 of the Health and Safety Code have been paid. If any <br /> of the USTs owned or operated had product placed in them on or after January 1, 1991, attach the <br /> most recent copy of the UST Fee Return Form filed with the State Board of Equalization (BOE)with <br /> proof of payment (copy of canceled check). Claimant submitted a BOE document for Hazardous <br /> Waste Generator Fee Return. We need this form for UST Maintenance Fee Return. <br /> • On page four of your claim application you indicate that your Insurance policy only applies for <br /> cleanup costs that exceed$150K and are not reimbursed by the UST Cleanup Fund. Please provide a <br /> copy of your insurance policy for our review. <br /> • Your Certification of Financial Responsibility form is being returned for completion. Please <br /> complete Section B.
