Ken Hilliard ENVIRuMVIE,Ji iitALTH P O Box 711 PERMIT/SERVICES Dallas,TX 75221-0711 UNDERGROUND STORAGE TANK CLEANUP FUND (FUND), REQUEST FOR FURTHER DOCUMENTATION DURING INITIAL REVIEW: CLAIM NUMBER 017982; FOR SITE ADDRESS: 2360 GRANT LINE RD W, TRACY After reviewing your claim application to the Cleanup Fund, we find that the following additional information is needed to determine your eligibility for placement on the Priority List: Supporting documentation submitted with the claim application reflects that directives or work performed was not in the claimant's name. The letter you submitted from San Joaquin County dated May 29, 2003 identifies YLY LLC (the property owner) as the responsible party. Claimant is advised that an eligible claimant must have either owned or operated the subject leaking UST, is the responsible party directed to undertake corrective action for the unauthorized releasees the local regulator and is the party paying for the costs of cleanup. Please clarify and advise. • Provide a copy of the first letter from the local regulatory agency naming you (7-Eleven, Inc.) a responsible party and directing you to cleanup the contamination at the subject site. • Claimants who acquire sites after January 1, 1990,must complete the enclosed Claimant Certification of Compliance with Fund Regulations Section 2811(a)(1)-(2) and Health& Safety Code, Section 25299.54, subdivision (h). AND • A copy of the permit to own or operate the UST from the local implementing agency dated between January 1, 1984 and January 1, 1990 (pursuant to Chapter 6.7 of the Health and Safety Code). • Claimant is required to provide documentation that all current and prior UST fees due on or after January 1, 1991 imposed by Section 25299.41 of the Health and Safety Code have been paid. If any of the USTs owned or operated had product placed in them on or after January 1, 1991, attach the most recent copy of the UST Fee Return Form filed with the State Board of Equalization (BOE)with proof of payment (copy of canceled check). Claimant submitted a BOE document for Hazardous Waste Generator Fee Return. We need this form for UST Maintenance Fee Return. • On page four of your claim application you indicate that your Insurance policy only applies for cleanup costs that exceed$150K and are not reimbursed by the UST Cleanup Fund. Please provide a copy of your insurance policy for our review. • Your Certification of Financial Responsibility form is being returned for completion. Please complete Section B.
