No waste disposal records were observed onsite for the metal fines disposal, and no storage container for metal
fines storage were observed onsite. Any person who generates a waste shall determine if the waste is a hazardous
waste. Immediately make a hazardous waste determination for the generated metal fines and manage it according the
Title 22 hazardous waste regulations. Particles 100 microns or smaller must be handled as hazardous waste if the
metal is determined to be a hazardous waste. Submit a statement and supporting documentation explaining how this
waste was managed by November 9, 2014.
2) The following medications are being supplied to patients at this facility (in form of inhalers which use
hydroflouroalkane propellant):Albuterol, Beclomethasone, BUdesonide/ Formoterol, Fluticasone, Ipratropium,
Levalbuterol, Mometasone/ Formoterol. These waste medications were observed throughout the facility in small RCRA
hazardous waste containers. During the September 23, 2014 inspection, Mr. Sasson stated that he now believes that
these used/waste inhalers are not RCRA hazardous waste and at this time their facility is looking into waste
re-classification. Furthermore, according to an email correspondence, received by the EHD on October 6, 2014 from
Donna Chun, PIC (pharmacist), "These chemical substances are not characterized as hazardous waste when
discarded."Any person who generates a waste shall determine if the waste is a hazardous waste and manage it
according the Title 22 hazardous waste regulations. Immediately make a hazardous waste determination for the waste
inhalers, and manage this waste stream according the Title 22 hazardous waste regulations. Submit a statement and
supporting documentation explaining how this waste was managed by November 9, 2014.
?p14
Note: This is a secure facility and since sampling equipment was not on the pre-approved equipment list upon facility
entry, no samples were collected in connection with these violations at the time of inspection.
Received by(initial): Inspector: Phone: Date:
ELENA MANZO, REHS (209) 953-7699 09/04/2014
Page 3 of 9
