Mr. Art Tanner - 2 - 8 November 2000
Waste Discharge Requirement Violations
• Wastewater is not being controlled on the application area. Some of the wastewater application
area did not have a surrounding berm and in one area, erosion of surface soils indicated water has
runoff the application area onto the neighboring property. All wastewater must remain on the
designated application area as described in Standard Provisions and Reporting Requirements,
General Provision A.12, which states, "The discharge shall remain within the designated disposal
area at all times. "
• The WDRs require West Coast Tomato to perform self-monitoring of the wastewater application
area and submit monthly reports. However, the Board has not received the reports. During the site
meeting it was noted that the monitoring has been performed, but not reported. WDRs Provision
E.1 requires, "The Discharger shall comply with the Monitoring and Reporting Program No. 95-
158, which is part of this Order, and any revisions thereto as ordered by the Executive Officer. "
Required Technical Report
By 22 December 2000, West Coast Tomato shall submit a report to the Board on the following items:
• A description of how the wastewater application area was improved to prevent wastewater runoff.
• A report presenting all the monitoring data collected in year 2000. If data is not available, then
the report shall describe the steps which West Coast Tomato will take to immediately implement
the monitoring and reporting requirements of Order No. 95-158.
If you have ariy`questions about this Notice of Violation or the report requirements, please contact Tim
O'Brien at (916) 255-3116. All future correspondence regarding this site should be addressed to his
attention.
Xij
WENDY WYELS, Chief
Waste Discharge to Land Unit
Lower San Joaquin River Watershed
cc: Mike Huggins, San Joaquin County Environmental Health Department, Stockton
